THE FOLLOWING DESCRIBES THE
USER AGREEMENT WITH HORSENGOGGLE.COM.

BY REGISTERING at HORSENGOGGLE.COM,
YOU ACCEPT THE TERMS AND CONDITIONS BELOW.

ELIGIBILITY.
Our services are available only to individuals who are at least 18 years of age. You must be eligible to make legally binding agreements. Minors may not use this site without the direct supervision of their parents or guardian. Minors may not bid on or create listings.

TRUTHFUL
You must provide truthful information about yourself and your items for sale. Your account may be suspended or terminated for providing false or misleading information.

NON-TRANSFERABLE
You may not sell your account or User ID to another party.

IDENTITY & CREDIBILITY
Horsengoggle.com cannot confirm that each user is who they claim to be. It is important that each member use this site with integrity as well as caution. Use this site at your own risk. To help develop member credibility, the feedback system is intended to help you evaluate sellers and buyers. We also encourage you to communicate directly with potential trading partners through the tools available on this site.

FREE REGISTRATION & BIDDING
There is no charge or fee to register at Horsengoggle.com. Bidding is free. If you bid on items listed on our site, then you represent that you are able to pay for the items you bid on.

SELLER FEES
There are Fees for posting and selling items, as listed on our Seller page(s). You are responsible for paying all fees associated with using our service and our website and all applicable taxes. We may in our sole discretion change some or all of our fees and services at any time. Users will be given advance notice of changes in fees and services.

US DOLLARS
Unless otherwise stated, all fees are quoted in U.S. Dollars.

AUCTION VENUE
Horsengoggle.com is an auction venue. Our users may offer to sell or buy items through online listings. Horsengoggle offers auction formats as well as classified ads. Horsengoggle.com is not an Auctioneer. We provide the venue, and as such we are not involved in the actual transactions between buyers and sellers. We have no control over whether the sellers or the buyers will complete the transaction. We do have the power to terminate any users who do not fulfill their obligation as a seller or a buyer.

SELLER OBLIGATION
Sellers are independent contractors, and therefore are solely responsible for the items they sell. Sellers are responsible for compliance with any applicable tax laws in their state. Seller is responsible for whether it is legal to sell the item(s). Seller is obligated to complete the transaction and sell to the high bidder. Seller and buyer should contact each other within 3 days of ended listing, to complete the sale.

BUYER/BIDDER OBLIGATION & DUTY
Buyers are obligated to pay for the listed items they win as well as any additional fees specified by the Seller in the listing. Additional fees typically include costs such as taxes, shipping expense, packaging and handling costs. By bidding on listed item(s) you agree to the terms and conditions of sale as stated in the item's description, so long as those conditions are not unlawful or in violation of this Agreement. Buyers have an obligation to read the entire listing description and seller's terms carefully before bidding. International buyers may also be responsible for customs fees in your own country: customs fees on packages are not the responsibility of the Seller and such fees are not included in Seller's terms because sellers are not able to obtain that information. Buyer and seller should contact each other within 3 days of ended listing, to complete the sale.

FEEDBACK
We encourage all users to leave feedback after transactions are completed, because this aids in developing a safe trading community. Feedback is voluntary: it is not required to leave feedback. Sellers and Buyers should never threaten negative feedback as attempted leverage. Misuse of the feedback system may be cause for suspension or termination of user privileges. Some online Sellers require Buyers to leave feedback first: we do not allow this policy at Horsengoggle.com because it is manipulation of the feedback system. Do not leave a negative feedback without trying to resolve the problem with the other user first. Feedbacks are an opinion. Do not use obscenity or vulgar language in your feedback comments.

USER DISPUTES
If you have a dispute with another user of Horsengoggle.com, it is up to the parties involved to resolve the issue between yourselves. The dispute may not be engaged on or carried over to listings, forums or the community center.

MANIPULATION
You may not manipulate the price of any item or listing, nor recruit others to help you manipulate the price of your listing. This practice is commonly referred to as shilling or shill bidding. You may not interfere with other user's listings or transactions. You may not attempt to manipulate feedback ratings for yourself or others, by threats or other means of manipulation.

CHILD SENSITIVE
Horsengoggle.com caters to a niche market for dolls, bears and toys. Therefore, it is very likely that children may view the listings on our site. Adult or horror items which may be graphic, sexual, frightening or shocking in nature are not allowed. However, parents must exercise caution: children should always be supervised if they are browsing the site. We do not control the information provided by users of the site. Some listings may contain information that you find offensive in some way. If you think a listing violates this Agreement, we do ask you to report it to us.

LISTINGS CONTENT
Seller must provide an appropriate, adequate description of their item(s) for sale, including but not limited to quality and condition of the item(s). Terms and conditions of sale (which typically include taxes, shipping costs, packaging and handling costs) should be described in the listing description so the buyer has a reasonable idea of what the final cost and obligation will be. Listings may not contain obscene or vulgar language. All listed items must be placed in an appropriate category. You may list no more than ten identical auction items at a time.

PERSONAL ADVERTISING
All item listings must sell a product or service. The Horsengoggle.com venue may not be used for advertising or recruiting purposes. You may not use a listing to advertise your business or online site. You are allowed to post your website url on your Horsengoggle.com personal information page, which does show up on auction headers. You may promote your own business as part of your Storefront logo and store information as long as such promotion is applied with reasonable common sense and is in good taste. You are not allowed to promote your personal business, web links, campaigns or causes in the listing descriptions. Our policy in regards to personal promotions is generous, so please respect these guidelines or we may need to add further restrictions to this policy.

PROHIBITED ITEMS.
You may not sell counterfeit items or stolen items or illegal items. You may not sell items or create listings that violate any copyright, trademark or patent laws. Pornography is not allowed. Horror items depicting torture, mutilation or abuse are not allowed. Items which may be graphic, sexual, haunted or shocking in nature are not allowed. If any of these prohibited items are listed on the site, the user will be suspended or terminated. Remember that Horsengoggle.com strives to be a child sensitive site, therefore all users are required to respect these conditions. We do reserve the right to solely determine what is suitable for listing on Horsengoggle.com.

PRIVACY.
We respect your privacy. We do not sell or rent your personal information. We have installed technical systems to protect your privacy and to preserve the integrity and security of the site. You may not attempt to gather information about other users of the site without their consent.

AMENDMENTS.
We may amend this Agreement at any time. Amended terms will be effective 30 days from the time they were posted.

NO WARRANTY
WE AND OUR SUPPLIERS PROVIDE THE HORSENGOGGLE.COM WEBSITE AND OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

LIMITATION OF LIABILITY
IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

GENERAL COMPLIANCE
You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your bidding on, listing, purchase and sale of items.

NO AGENCY
You and Horsengoggle.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

INDEMNIFICATION
You agree to indemnify and hold harmless Horsengoggle.com, its owners, officers, employees, parent companies, subsidiaries, contractors, vendors or affiliates, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Horsengoggle.com site, the violation of this User Agreement by you, or the infringement by you or any other user of this site using your computer, of any intellectual property or other right of any person or entity.

VIOLATION OF USER AGREEMENT
We may terminate your account registration temporarily or permanently should you violate any portion of this User Agreement. This includes the termination or suspension of any listings you may be running at the time, without refund of any fees or compensation or liability for loss of business or revenues which you may claim, as a result of such termination.

DISPUTES
If a dispute arises between you and Horsengoggle.com, it is our intention to resolve the dispute quickly. This Agreement shall be governed in all respects by the laws of the State of Florida as they apply to agreements entered into and to be performed entirely within Florida between Florida residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Horsengoggle.com must be resolved by a court located in Pasco County, Florida, except as otherwise agreed by the parties. You agree to submit to the jurisdiction of the courts located within in Pasco County, Florida for the purpose of litigating all such claims or disputes.

GENERAL
We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
